Los Angeles illegal Fireworks Lawyers

Historically speaking, California has been quite divided on which fireworks should be used to observe the Fourth of July celebration. For example, San Diego Counties have been quite strict in not allowing any sort of firework for many years while Los Angeles has been more open to the use of fireworks in general. That being said, there have been several crack downs recently in relation to fireworks in Los Angeles. If you are unsure of which fireworks are legal and safe to use this year for your Fourth oF July plans or you have been caught by local law enforcement with illegal fireworks, it is wise to consult your local law firm and also the fire department for pertinent information regarding your potential claim to combat the charge or the latest regulations for fireworks.

What gets confusing for many Los Angeles residents is that there has been a change in legislation to stipulate that there are some fireworks for sale that are known as “Safe and Sane.” These “Safe and Sane” fireworks are the only fireworks permitted in any Los Angeles County. Where one has to be careful is that your local county ordinance may even make these “Safe and Sane” fireworks outlawed entirely. Furthermore, if you have older fireworks that do not meet the “Safe and Sane” requirements, you still may be liable if you use them going forward even if you purchased them when they were legal in Los Angeles.

Given how complicated it is to obtain fireworks legally in Los Angeles that meet the required specifications, it is wise to research carefully before you purchase any sort of fireworks for this year’s Fourth of July Celebration. “Safe and Sane” fireworks are able to be purchased at your local State Licensed Fire Marshall Station if the local ordinance permits their use within your specific district. Typically, if the “Safe and Sane” fireworks are permitted, they are on sale from noon on June 28th to noon on July 6th. If you do decide to purchase at another locale, you do so at your own risk because the vendor will likely be selling fireworks that are no longer legal in Los Angeles County. If you are subsequently caught with these fireworks or you are reckless and cause damage to another with these fireworks, you will have very little defense in any ticket or legal action that may be brought against you.

If you have missed any of these regulations and run into trouble in connection with your Fourth of July Celebration, it is highly recommended that you consult with your local law firm to ensure that you have the minimum amount of charges possible on your record. Additionally, if there was an error in your charging, attorneys are here to help you navigate the pertinent legal issues to your case and resolve any discrepancies that you may have with law enforcement officers. What is important to remember is that law enforcement officers do make errors as well, which is why it is always wise to get a second opinion.
