Can I get a Plea Bargain in a Los Angeles DUI Case?

  • August 30, 2017

A DUI arrest is a scary thing for people who are pulled over. Sometimes the events of the arrest can be blurry, especially if you’re outright not guilty and completely surprised by the arrest. When officers arrest you, remember that this is not a guilty verdict. It means that they suspect you were driving under the influence. Just like any other crime, you are innocent until proven guilty in a court of law. Make sure you don’t enter that court of law and plead guilty right away. By doing so, you throw away all your rights to bargain with prosecutors and have your case dismissed or reduced.

A guilty verdict comes about in two ways: Either the prosecution proves you guilty in a trial by jury or you voluntarily enter a guilty plea in court. Entering a guilty plea sometimes works to your advantage. It takes enormous resources to try a case by jury. Whenever possible, prosecutors will work with you to reduce your punishment if you enter a guilty plea. This is called a plea bargain. In exchange for your plea, prosecutors will give you a “deal” that supposedly works in your favor. If you have a veteran lawyer on your side, you’re more likely to get a better plea bargain.

Even a first time DUI can have some serious consequences. You can potentially face months in prison, inpatient alcohol rehabilitation, and fines in misdemeanor cases. In felony cases, you could face a year or more in jail, license suspension, insurance rate hikes, and much more unpleasantness that you won’t want to face. For second DUIs, the possible consequences are even heftier and more unpleasant to face. It’s no wonder that so many people accept the first plea bargain that they’re offered without even talking to a lawyer. In many cases, they might get probation and believe the nightmare is over. In reality, a good lawyer might have been able to get their case dismissed.

In cases where a dismissal doesn’t seem likely, our lawyers go to work for you around the clock to make sure that you’re going to get the absolute best plea bargain out there. Our attorneys are former prosecutors and realize exactly what a good plea bargain looks like. You have extenuating circumstances, too, if you are a businessperson or a worker. Jail time in that instance may not be a possibility. A good lawyer will be able to help you avoid jail time in most instances by reviewing the circumstances of the case. In all but the most blatant violations, we’re able to get you a plea bargain that doesn’t include jail time.

A plea bargain might seem like a kind gesture from a prosecutor, but believe us. As prosecutor’s, we realize that what prosecutors first look for is a HIGHER punishment than you deserve. We’ve worked on these cases ourselves and know that the first plea bargain isn’t much of a bargain at all. From time to time you will get a prosecutor that offers something fair from the beginning but this is the exception rather than the rule. Let us take on your case and show you what working as a prosecutor as your defense attorney can do for your final outcome. We have been working for decades in DUI cases. We know what we’re doing.

Criminal charges for a DUI are included in the California Vehicle Code 23152. We know this code well and have helped out clients perpetually by learning it more as we go along. We’re a Los Angeles DUI attorney that truly believes we are doing the work of the people by giving people with a DUI charge the opportunity to rehabilitate their lives. Sometimes, especially on a first offense, we have the opportunity to give rehabilitation instead of incarceration to our clients, and that’s what our goal will always be. We want you to honestly assess your life, as a free person not in jail, and make the necessary changes to never need our services again.

With our experienced team on your side, you’re going to take a plea bargain much more confidently. We know what makes for a fair plea bargain. If you plan to plead guilty anyway, please contact our law offices before doing so. We can help you avoid making any mistakes by thoroughly examining the bargain and making sure you’re doing the right thing.
